These Terms of Service (“Terms”) govern your access to and use of the 1VM application, website, and related subscription service (collectively, the “Service”). By downloading, installing, or using the Service, you agree to these Terms.
Eligibility
You must be at least 13 years old to use the Service. By using 1VM, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
The Service
1VM is a virtual machine desktop for macOS. It includes a QEMU runtime so you can create and run guest systems locally on your Mac. The free plan includes one virtual machine and does not require an account. 1VM Pro unlocks unlimited machines and is billed at $1/month or $10/year.
We may add, modify, or remove features at any time. The Service is provided on an “as available” basis. Guest operating systems, installers, and disk images are provided by their own publishers and are not part of 1VM.
Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe the intellectual property or privacy rights of others
- Distribute malware or other harmful content
- Attempt to gain unauthorized access to systems, networks, or accounts
- Interfere with the subscription service or other people’s use of it
- Share, resell, or misuse a Pro subscription
You are responsible for the guest systems you install and for how you use them. We may suspend or terminate access if we reasonably believe you have violated these Terms or put the Service or others at risk.
Accounts and devices
Pro requires Google Sign-In so the subscription can be restored on your devices. You are responsible for the security of your Google account and your Mac. We are not responsible for unauthorized use of the Service through your account or device.
Payments
Paid plans are processed by Stripe. By subscribing, you agree to pay the price shown for the billing period you choose and to Stripe’s terms for that payment. You can cancel future charges in the app or through the Stripe customer portal. Cancellation and refunds are described in our Refund Policy.
Third-party software
The Service includes or depends on third-party software, including QEMU, and connects to Google and Stripe when you use Pro. Your use of those products is also subject to their terms. We do not control guest operating systems or websites you reach from a virtual machine.
Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that a particular guest operating system will install or run on your Mac.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1VM AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF VIRTUAL MACHINE DATA STORED ON YOUR MAC.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ZERO IF YOU USED ONLY THE FREE PLAN.
Indemnification
You agree to indemnify and hold harmless 1VM and its operators from claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your virtual machines, or a violation of these Terms.
Changes
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when they were last revised. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Termination
You may stop using the Service at any time by uninstalling the app and, if you subscribe, canceling Pro. We may suspend or end access to the subscription service for a violation of these Terms.
Governing law
These Terms are governed by applicable law in the jurisdiction where the Service operator is established, without regard to conflict-of-law principles, unless mandatory local law requires otherwise.
